The traditional legal process is adversarial and makes the conflict a “win/lose” proposition. It seeks to exploit the advantages one party has over the other. Decisions may be left in the hands of a judge who knows very little about either party. It is expensive and often destructive of relationships that necessarily must continue. When parties have children, they will have an ongoing co-parenting relationship. The success of that relationship largely determines how the children will emerge from the breakup of the marriage or partnership. Emphasizing the conflict through a traditional legal process can make the road ahead much more difficult.
